These Terms and Conditions set out the basis on which Rubbish Removal Putney provides rubbish removal and waste collection services. By placing a booking, you agree to be bound by these terms. Please read them carefully before confirming your order.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Client means the individual or business requesting rubbish removal or waste collection services from us.

Company, we, us, our means Rubbish Removal Putney, the provider of rubbish removal and waste collection services.

Services means any rubbish removal, waste collection, loading, transportation, and related services supplied by the Company to the Client.

Booking means a confirmed request for Services made by the Client and accepted by the Company.

Waste means any items, materials, refuse, junk, furniture, appliances, garden waste, construction debris, or other materials to be removed as part of the Services, excluding any prohibited or hazardous items that we are not permitted to carry.

2. Scope of Services

We provide rubbish removal and waste collection services for domestic, commercial, and light construction clients. Services typically include loading waste into our vehicles, transporting it to licensed waste facilities, and disposing of it in accordance with applicable regulations.

The exact scope of the Services will be as agreed at the time of Booking, based on the information you provide. This may include, for example, household clearances, office clearances, garden waste clearance, and small-scale builders waste removal.

We reserve the right to refuse to remove any item that we believe is unsafe, unlawful to transport, or falls outside the agreed scope of Services.

3. Booking Process

3.1 You may request a quote or make a Booking by telephone, email, or any other method we make available. When you contact us, you must provide accurate and complete information about the type and volume of waste, the location, access conditions, and any other relevant details.

3.2 We may offer an estimated price based on the information you provide. Final pricing may be confirmed on site once our team has inspected the waste. If the actual volume, weight, or type of waste differs from that described, we may adjust the price accordingly.

3.3 A Booking is only confirmed when we accept your request for Services and provide a date and time window for collection. We may, at our sole discretion, refuse any Booking.

3.4 You are responsible for ensuring that someone with authority to approve the work is present at the property at the agreed time of collection, unless we have expressly agreed alternative arrangements in writing.

4. Access and Client Responsibilities

4.1 You must provide safe and reasonable access to the property and to the waste to be removed. This includes ensuring that any parking restrictions, access codes, security gates, or other obstacles are addressed in advance.

4.2 Where parking fees, congestion charges, tolls, or similar charges are incurred to access your property or complete the Services, these may be added to your invoice unless agreed otherwise.

4.3 You must ensure that the waste to be collected is clearly identified and separated from items that are not to be removed. We will not be responsible for removing items that were not clearly designated as waste, or for any loss arising from such removal where identification was unclear.

4.4 You are responsible for obtaining any necessary permissions from landlords, neighbours, building managers, or other relevant parties to allow us to carry out the Services at the property.

5. Waste Types and Prohibited Items

5.1 We are a waste carrier and will only remove waste items that are lawful for us to transport and dispose of under applicable legislation and our waste carrier registration.

5.2 We do not remove certain hazardous or specialist waste, including but not limited to: asbestos, clinical or medical waste, chemicals, solvents, oils, gas bottles, explosives, firearms, and other regulated dangerous goods.

5.3 If you present hazardous or prohibited items for collection without prior written agreement, we may refuse to remove such items and may charge an attendance or waiting fee to cover our costs.

5.4 If hazardous or prohibited items are concealed within general waste and not disclosed at the time of Booking, you may be liable for any additional costs, fines, or liabilities incurred by us as a result.

6. Pricing and Quotations

6.1 Unless we have conducted a site visit in advance, any price we provide before arriving on site will usually be an estimate only, based on the information provided by you.

6.2 Our charges may be based on volume, weight, labour time, access difficulty, and type of waste. Any applicable additional fees, such as for heavy materials, specialist items, or difficult access, will be explained where reasonably possible.

6.3 If, upon arrival, the waste is substantially different in volume, weight, or type from that described, we may revise our quotation. If you do not accept the revised price, we may cancel the Booking and may charge a reasonable call-out fee.

6.4 All prices are stated in pounds sterling and may be subject to applicable taxes, which will be clearly indicated where charged.

7. Payments

7.1 Payment is due in full on completion of the Services, unless we have agreed alternative payment terms in writing before the Booking.

7.2 We accept various payment methods, which may include cash, debit or credit card, or bank transfer. We do not accept payment by cheque unless specifically agreed.

7.3 Where Services are provided to business customers on account, invoices are payable within the agreed payment terms. If no specific terms are agreed, invoices are due within 14 days of the invoice date.

7.4 If payment is not received by the due date, we reserve the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs of debt recovery, including legal expenses.

8. Cancellations and Amendments

8.1 You may cancel or amend your Booking by giving us reasonable notice prior to the scheduled collection time.

8.2 If you cancel a Booking less than 24 hours before the agreed arrival window, we reserve the right to charge a cancellation fee to cover our costs, including allocated staff and vehicle time.

8.3 If we arrive at the property at the agreed time and are unable to carry out the Services due to issues outside our control, including but not limited to lack of access, no authorised person present, or unsafe conditions, this may be treated as a late cancellation and a call-out charge may apply.

8.4 We may cancel or reschedule a Booking due to events outside our reasonable control, including severe weather, vehicle breakdown, illness, accidents, or other operational issues. In such cases, we will use reasonable endeavours to notify you and arrange an alternative time. We will not be liable for any loss arising from such cancellation or delay.

9. Service Performance and Time Slots

9.1 We will use reasonable efforts to attend at the property within the agreed time window. However, all arrival times are estimates and may be affected by traffic, weather, and operational conditions.

9.2 We do not accept liability for any loss, damage, cost, or expense arising from delays in performing the Services, provided we have acted with reasonable care and diligence.

9.3 If we reasonably believe that carrying out the Services would be unsafe or unlawful, we may suspend or refuse the Services until the issue is resolved.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill in providing the Services. However, you acknowledge that some risk of minor damage can arise when removing bulky items or navigating tight spaces.

10.2 We will not be liable for any pre-existing damage to property, fixtures, or fittings, or for any damage that arises due to structural weaknesses, poor installation, or defects in the property or items being moved.

10.3 To minimise risk, you should protect floors, walls, and other surfaces where possible and remove any fragile items from the working area before our arrival.

10.4 Our total liability to you for any loss or damage arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the amount paid or payable by you for the specific Booking giving rise to the claim, except where such limitation is not permitted by law.

10.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited.

10.6 We will not be liable for any loss of profits, loss of business, loss of opportunity, or indirect or consequential loss suffered by you in connection with the Services.

11. Waste Transfer and Environmental Compliance

11.1 We are committed to carrying out rubbish removal and waste collection in compliance with applicable environmental and waste management regulations.

11.2 Where required, we will complete any necessary waste transfer documentation to record the movement of waste from your property to a licensed facility.

11.3 We will deliver collected waste only to appropriately licensed or permitted waste transfer stations, recycling facilities, or disposal sites, and will take reasonable steps to maximise recycling where practicable.

11.4 Once waste has been removed from your property and loaded into our vehicle, ownership and responsibility for that waste passes to us or to our appointed waste partners.

12. Client Warranties

12.1 By using our Services, you warrant that:

a. You are either the owner of the waste and the property from which it is being removed, or you have full authority from the owner to instruct us to remove the waste.

b. The waste presented for collection does not include any prohibited or hazardous items that you have not previously disclosed.

c. All information you provide to us is accurate, complete, and not misleading.

12.2 You agree to indemnify us against any loss, cost, or liability we suffer as a result of a breach of these warranties, including any claims made by third parties regarding ownership of the waste or property, or any illegal or hazardous waste you instructed us to collect without proper disclosure.

13. Complaints and Dispute Resolution

13.1 If you are dissatisfied with any aspect of our Services, you should contact us as soon as reasonably practicable, providing details of the issue and any supporting information.

13.2 We will investigate complaints in good faith and aim to resolve them promptly, offering appropriate remedies where we consider a complaint to be justified.

13.3 If a dispute cannot be resolved informally, either party may pursue their legal rights in accordance with the governing law and jurisdiction set out below.

14. Privacy and Data Protection

14.1 We may collect and process personal information about you in order to manage your Booking, provide the Services, issue invoices, and communicate with you.

14.2 We will handle your personal information in accordance with applicable data protection laws and use it only for legitimate business purposes relating to the provision of our Services, unless we are required by law to disclose it or you have given your consent to other uses.

15. Changes to These Terms

15.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated to you.

15.2 The version of the Terms and Conditions that applies to your Booking will be the version in force at the time your Booking is confirmed.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or relating to these Terms and Conditions or the provision of our rubbish removal and waste collection Services.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17.2 No failure or delay by us in exercising any right or remedy shall constitute a waiver of that right or remedy, nor shall it prevent or restrict the future exercise of that or any other right or remedy.

17.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations, provided that this does not materially affect the standard of the Services you receive.

17.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the Services and supersede any prior understandings or agreements, whether written or oral.
